No custody have rights???
My Hubby's ex is putting so many obstacle's for him & their child. He got behind this past month on child support cuz he lost his job, but she is asking for the past month & 2 more months of child support, so she can allowed their child to spens summer vacations with us( they live 16 hrs 4rm us) & he needs to pay 2 way trip airplaine ticket plus buy him clothes & shoes cuz The MOM only allowed for him to bring 1 set of clothes (the one's he has on) It is not about the money well except for the advance money that she wants & we can't afford right now. But she is always doing what she wants & not following court orders. So what can he do? Does he has rights? Is she violating her childs rights too?? By the way their son is 10 so he does what mommy says . I don't like the way she is with either of them . How can I help???

Yes your husband has rights, and they should have been spelled out in the divorce decree. If his EX is not complying with the divorce then you need to get a lawyer (your community may have a legal assistance office) and file contempt of court charge against her. There are other options but you really need to get a lawyer to be sure that you are protecting your rights as you go through he court process.

Child support has absolutely nothing to do with visitation. Whether you are paying or not, she cannot keep the children away from you. She cannot violate an order or custody agreement just because your husband is in arrears. That is up to the court to decide. You should go back to court and have child support modified to fit your current living situation since your husband lost his job or have the judge decide arrangements for catching up. If you are going to be keeping the kids for an entire summer, I would suggest seeking joint custody instead of letting the ex have full custody. This will give your husband more clout in decision making as well.

My brother has been going through this kind of thing. His ex met someone the Internet and was moving across the country and left the child. He has gone to court and gotten temporary custody. I wish you luck. Get a good lawyer and stick to your guns.

you need to talk to a lawyer because he dos have rights he has to be further behind than that before she can make demands she can not ask for more money in advance that is illigal there may be a legal aid lawyer in your town you need to contact them because this not legal or right
