Yep, I bit down on a metal screw. What should I do. I have witnesses, the screw, and motivation.

You didn't mention whether you incurred any injuries.

If you were not injured, don't bother. If it actually gets to court, you will not win and it will still cost you lawyers fees and possibly lost wages from time off at work.

If you were injured, did the restaurant offer to compensate you for your injuries such as paying your dental bills and also did they follow through with what they offered? If they did, why not give them some slack? It's not like you found something that was completely disgusting like a dead rat.

Remember that if you file a lawsuit that is frivolous, we all pay for it in the end. Insurance rates go up because of such suits. The cost of products and meals go up because they need to print obvious, stupid messages on coffee cups that say "Caution: Coffee is hot" to protect themselves from lawsuits. (Of course it's hot!!!! It's coffee!!!! You would be upset if it wasn't!!!!) It costs the McDonalds of the world money to print that on the cup and do you think they are going to just take that as a loss? Of course not, they are going to raise their price to cover their additional expenses.

With that said, you are certainly entitled to compensation for any injuries you incurred, including for any long term effects. If the restaurant is not doing the right thing and offering to cover any medical expenses then you should, without question, sue.

I would not sue just because it happened.

I would get the first available appointment with my dentist, tell him what happened (show him the screw) and have him do a x-ray and check everything out in there to make sure I had not cracked a tooth or damaged my gum. If that exam showed everything was fine, I would contact the management of the restaurant to let them know I was OK - and to give them an opportunity to offer me a gift certificate or something.
If the dentist has bad news, all bets are off. Contact an attorney. You are going to want legal counsel on this.

Did it hurt you? (break skin, crack tooth)
Did you call it to the attention of the manager?
Did the manager offer to cover your meal (and/or meals of your companion(s), and/or cover any medical expenses?

If you're injured, and they're not taking care of you - then sue.
Otherwise, I'd leave it alone.

I would sue that could of broke your tooth or worst you could have swallowed it or old that meal for your child.

i work in a resteraunt i dont see how the hell a screw would get in your food. they obviously dont practice safe work habits back there.
