I have a friend and he owns his own nails shop. A few years ago, he helped his wives uncle who was in Vietnam to come to the United States by singing an affidavit. This family member was living in Massachusetts until his Visa expired and he was arrested and taken to court. After that he bailed out and came to California. Sadly you would think that he would be thankful to my friend but no, to the contrary he decided to open up a nail shop right next to my friends. And to make the matter worst, he distributed flyers telling people that if they came from (X) shop will get a 50% discount the first time of their visit. My friend confronted him and told him to stop and the uncle didn’t care. So now we are looking for the right place where we can report this family member for being in California not only with an expired visa but also with a warrant from Massachusetts.

Good luck, as I understand it now, in California the Immigration will not come out and pick up an illegal, especially on a complaint.
Some good news: In San Diego County, people who have been arrested and are in jail for crimes are going to be checked to see if they are here legally and possibly deported if not. However, they still need to work out the details with the Federal Government.

Your problem is not the immigration service failing to deport the Vietnamese national. Your problem is your friend got out flanked in her business and you two are whining about it.

Go ahead and kick the guy out of the country. What's going to happen when the next Vietnamese family comes along and opens shop where he left? Your friend is going to loose business to them too. Wanna know why?

I have family and many friends who are manicurist (I'm half Viet and was born here). My caucasian manicurists friends are always whining about the Viets and other orientals taking their business, but don't do a damn thing about it. NONE of my caucasian friends do a single bit of advertising because they expect and endless supply of clients to magically show up at their workstation.

When some guy or girl spends $10 on a stack of flyers and starts passing them out in front of your friend's salon, what do you think is going to happen? YOUR FRIEND IS GOING TO LOOSE BUSINESS... It has NOTHING to do with INS, but has EVERYTHING to do with your friend being stupid, lazy or both.

The Vietnamese had it incredibly tough in Vietnam and can be ruthless business people because they had to deal with an incredibly ruthless government. I will assure you that if you succeed in kicking the Viet guy out of the country, dozens of his family will open shop where he was and your friend will be looking for a change in careers.

My advice: Go buy a book on advertising fundamentals or take a business class at night or make your own damn flyer and start passing them out in front HIS business.

I doubt that you will pick me as your best answer, but at least you learned something from my post.

Be careful of what you wish.

You can call (ICE) Immigration and Customs Enforcement. But they will check out you, your shops, and your family member(s).

how sad...if I were you, I would figure out how I would deal with it if he weren't here illegally. You don't have a problem with him being here illegally, just how he's behaving, so I don't know if I would exploit that, just to get him to stop. That's touchy. He's not your family, I would stay out of it, let your friend deal with his family

If you are concerned about his business ethics you can contact the better business bureau in your area and they may be able to help with both problems
