She works at a fuel station and a lady ran over her ankle and consequently has lost $3,000 dollars in medical treatment and lost wages.She asked me to research how much one should ask for in this type of scenario. The insurance company supposedly has offered $9,000... is it common to obtain more? Any insight would be greatly appreciated.

don't take the settlement without consulting an experienced personal injury attorney with a good reputation. Contact your state bar association for a list of referrals. Sometimes the insurance offer is decent sometimes it is way too low. Keep in mind that if you hire the an attorney his fees will come from your end of the settlement (unless you have make some other type of arraignment) so if you think you won't get more than $9000 just take the offer. But you might get more and it sounds to me like it is worth more.

Sorry to hear about your mom's injury. do not settle with the insurance company without consulting an attorney. I tried to do this and really got taken. I lost out completely by allowing the insurance company free reign to medical records. If you are in san jose area, I have incredible injury attorney, mike fitzsimmons at 408-295-7701. I interviewed 7 other attorney firms before I found mike. he was the only one that was caring enough and willing to help after I made it difficult by dealing with insurance company myself. Even if you are not around here, call a few attornies and see what they tell you free of charge before you commit. Once, I had an attorney get me 5 times my medical bills, another time , hardly nothing. So you can see that it varies with each attorney and each case. good luck to you

insurance should cover her medical expenses, but lost wages is just a formula. How much does she make and how long is she going to be out of work. If its a permanant injury and she can not work anymore get an attorney.

In the meantime if she can not work, she should be going on disability which will pay for part of her lost wages as well.

if she has residual disability like permanant damage or permanent limp or disfigurement then she can get more.but if she is back to normal then its less likely that she will get anymore than 9000.
