We have never gone to court i am mom live in iowa he lives in washington state with dad.....do we both have rights untill court says otherwise?

well im not sure if the laws are diffeant there then here but here if ur not married the mom has full custody unless u go to court and give it to him but since he lives with his dad that might make things a little more complicated so if u really want to know about this you shold call your city hall or court house and ask them waht the laws are on child custody best of luck to you

Equal parenting is the way to go! If you have issues that preclude this, talk to your lawyer. If there are no issues, time sharing should be as equal as possible. See your local state/provincial websites for information.

By the way, don't let money issues cloud parenting issues. I see more parents rallying for full or sole custody because the child is worth $600 per month. Wrong, wrong.

im in a custody battle with my ex boyfriend now i left state with my son when he was only 6 weeks and i talked to three lawyers before i left to make sure it was legal. They all said that since there is no paperwork filed for us to be in court for custody i was considered the legal guardian and could do pretty much what ever i wanted...he has no rights til we go to court. if your married i dont think its much different but you could always call a lawyer and ask.

You both have rights to the child but as the mother you have the most chance of getting custody unless the father can prove somehow that you are unable or unsuitable to take care of the child.

Yes you both have rights. If you want sole custody you have to go to court. My boyfriend just got custody of his son and it took a year. He was hell for us but it was well worth it.
