She had the kids, but when they went to stay with him for a week, he kept them, moved and won't let her have them. She's contemplating getting them to meet in public and taking the kids back until the temporary custody hearing. The dad is a low-life slacker who hasn't worked in 13 years. He's a user and a manipulator and he takes care of the kids, but he has never been a provider and I don't think any judge with half a brain would give him temporary or even permanent custody. What should she do?

Well, acually my mom is in this same delima!!! Her ex husband had a little boy, when they got divorced he started picking a custody battle. The best thing to do is chill. If he is such a lowlife he won't have a chance with the judge, as you said. Does your GF and her ex live close or in the same town. My 'rents have put together a scuedule. I go to my dads on sun,mon,tue,and wed and Im with my mom the rest of the time maybee they can work out that agreement. Or, if proper agreement is not an option try going to a minimal contact, between him and you. The kids are sure to want to see there dad even if it is only once a month so u have to think about whats best for them. Gracie.

Uh, call the police. As of right now, he is violating court orders (Correct?) I would go hunt him down like a dog and take the kids back. She needs to make sure she has a good lawyer too. This can be used against him in court too. He has taken the kids and ran so they def won't give him custody.

What i can say is get a lawyer?? i KNOW they are expensive, but they are worth it. If not there is always free help & lawyers at the child support office tell your girfriend to go & look for help there. Another thing was/still she married 2 this jerk? Cuz if she is it will affect the fact that you are w/ her it can be against her if she wasn't legally married then it should be okay in a way! That's say a good thing that you want to help that means that U love her. I suggest one of those 2 things what ever U think U can, hopefully you can do something against this jerk ... You can even acusing him of kidnapping cuz it was against her that he took this kids. GOOD LUCK finding help & hopefully she can have her kids w/ her soon ...Best Wishes !!

Go to the police to get your kids back. Isn't that sort of like kidnapping ? If that doesn't work, wait til the hearing. 95% of the time the judge will rule in favor of the mother having custody. Unless the father can prove she is unfit. But most of the time they can't, unless there is abuse and they can prove it. It's sound to me like the father is behaving very poorly and is lacking in judgment. Which could hurt him on his part during court.

Okay, if mom has custody, she has a COURT ORDER stating so. She needs to go to the police. Obviously, she is still able to reach him by phone?? so, think logically. This isn't a custody battle, this is a kidnapping.

If there is a current court order stating that she has custody, then he's breaking the court order. However, if there is no court order, then unfortunately it isn't kidnapping because they are his kids too. But it works the other way around...tell her to go grab those kids back! :)

it would basically injury you if it became a courtroom order restraining order. she has a non everlasting civil risk-free practices order. no longer comparable to a restraining order. in case you wanna pay the money for a TPO against santa clause, you may. It shouldn't injury your possibilities. basically save information of what a bad mom she is.
