i want to know why since i gave my ex a house with ten acres of property paid for, i pay thirteen hundred a month for a mortgage, i make 40 grand a year, her husband makes60k he and his three kids are considered a hardship for her i have one child with her i get no hardships because i have no other children she gets 7 ,she gets the tax deduction ,the court wants me to pay 583 a month they call it 32%me 68%her i take my daughter to school & pick her up my fuel bill is 200 per month i buy her clothes whatever she needs my ex has never worked ,the court gave her a min wage income it ends up not counting. my real questions are if her husband lives there and supports his own children why are they her hardship, they shouldent count or her kids from other people that is her fault for having more kids not mine. and also does it cost 583 a month for food meds when i also support her when shes with me?

Her new husband is not responsible for the children.

I'd go back to court. I get $581 a month for 3 kids. My husband pays out $678 for his child support and that didn't count at all for me as a hardship. My kids don't count as my current husbands hardship in his child support payments. His kids should not count as her hardship. GOOD LUCK!!

her new husband and his income doesn't come into account. He could be earning double your wage and it still wouldn't change you being required to pay child support. It is between you, your ex and the child you both support that child support are concerned with. BUT, if you are driving to and from school and making purchases for clothes etc, (providing you have an agreement with your ex) this should decrease the amount of support you pay your ex. If these extra expenses are not taken into consideration you have 2 options. *stop supplying the extra expenses (thats what your child support payments are for) or *decrease the payments to your ex (legally) because you are providing more support than you are being acknowledged for. You may wish to find out about "SHARED PARENTING" (this means you are entitled to pay less maintenance because you are caring for the child for more than the required amount of hours that you are currently paying support for)

I know exacly what your going threw. My boyfriends son mother was getting damn never every penny from him. She was even buying him anything with but she always looked nice. She would have her hair done and her nails. My boyfriends son wouldn't even have socks on his feet. We we to court and got sole custody of him. It took a year being in and out of court but it was well worth. Get you daughter away from the goldigger FAST.
