if you have full custody then yes, but if your ex has had the kid for two years the child may already be adjusted to living with the other parent, if he or she is old enough and can make a decision of who he/she wants to live with then ask, but only place a child to live somewhere else when it is in the best interest of the child, if you are the better choice then explain to the child that they will be coming to stay with you and that this does not mean that they will not be seeing dad anymore

It will depend on the judge and also if your ex does not put up a fight. Did you have custody and signed custody over or did you just give your child to him for 2 years with out involving the courts? The reason why I ask, is because, he could get you for abandonment or the judge may want to know what happened in your life to give the child away.

Under usual circumstances, the answer is yes. Because it is implied that you gave your ex permission to have your daughter. However, he can return to court and request that the custody be changed. You both have the right to go to court to change custody until your daughter reaches 18 in California, some states it is 16 or your daughter asks for and obtains from the court emancipation--this means she is not under the custody of either parent. you can try. i know that i went through this. my ex had custody and my daughter lived with me for 11 months. he went to sign her out of school and take her to his house. he got away with it because he did it too late in the afternoon to get a judge's signature, but I had her back by 8:15 the next morning when he took her to school. Now I have full custody. If you want your daughter back, you will probably have to go through the courts again- your ex can do it very easily.

If you have full legal custody your daughter has been visiting her father. It is best by far that you share your child. If the father is abusive for real with no exaggeration then go pickyour child up. If you husband resists call the police for a civil escort. Do not lie about how your husband treats his child. If you lie and say he abuses her you will go straight to Hell.
The judge will want to know why you suddenly want her back.
A judge will always allow the mother to be a the mother as long as she is decent.

As long as the custody papers have never been changed then they still apply. If the other parent decides to fight it you can call the sheriff dept and present the custody paper to them and they will enforce the court order

why did they have her for 2 yrs.? Taking her back is no problem. the kid may not want to go. you must be careful and decide what is best for the child.
