Go to a lawyer. There's a thousand personal injury lawyers. They'll get you much more than if you were to try and settle on your own and the majority of them do not require any type of actual payment from you. They'll just take part of the settlement. Usually a third.

Do not sign ANYTHING until you have discussed this with your medical insurance provider. They will file a claim with the other party's insurance company to recover their loss in treating you. If you sign a waiver and settlement of claim, they will be pretty upset with you, and may stop covering you for the medical bills! They have a valid third-party claim and will want to be reimbursed. If you sign a waiver, that will exclude them from filing that claim on your behalf.
There is a good chance that the medical bills may significantly deplete the funds available for any pain and suffering claim. That would then need to be filed directly against the other driver.
In this case, it would be a good idea to discuss it with an attorney as well. He can see if the other driver has any assets that might be worth going after in a law suit. If the other driver is a "working stiff" with minimum liability there are probably no assets worth going after and the insurance coverage will leave little for a pain and suffering claim after your medical insurance provider is reimbursed.

I had the very same accident and injuries. Going to a lawyer is fine but you will get your money much faster and easier if you just settle with the insurance co. If your injuries are only what you have stated...2 years ago, I got $20,000 within a few months. Did not have to give 30% of it to a lawyer. Just wait a few months and see what their offer is. Make sure you will have no other lasting injuries later on.

The insurance company is looking for one thing, your signature on a release after they offer you some cash settlement. Do not sign without, as suggested by the other answers, seeking competent advice from an attorney that specializes in such cases.

RE :Insurance Cash Settlement - Car was rear ended I have whiplash?
Was hit from behing on freeway exit by a car going about 35 - 40 mph while i was stopped at the light. My Dr. has diagnoed cervical and lower back whiplash. The person hit me is insured and yes the insurance co has accepted liability. I am in CA and not sure what "soft tissue" laws are. Yes I am looking for cash settlement for pain and suffering. They have already put me in a rental car and my car is in shop being repaired. Out of pocket medical expenses are minimal for me because I have my own health insurance and only have a co-pay. Dr. also is having me go to physical therapy.
