My bf has a child that he's paying child support on, he's in arrears. We are about to have a baby of our own and want to get married, but if we get married will I be responsible for his back child support? His tax returns are taken, will mine be taken, too even if we file separately?

Not necessary to file separate tax returns, but be sure to file an Injured Spouse form with your return. This is a document that prevents YOUR portion of a tax refund from being intercepted for back support. If you don't file that, it can all be intercepted. Good Luck!

No. (I live in Illinois). HE is responsible. If you work, they cannot take your money or your tax returns as long as you file separately. Congrats on the baby!

No, you just file separately. Just remember if you two get divorced he'll probably not pay child support for your child either.
