Hopefully he had insurance, if so, his insurance co. should pay. Yes you can sue, anyone can sue anyone, but you may or may not win, you would have to consult an attorney.

Also you receive in your law suite a separate check for the vehicle damage (that is usually issued before the suite has even finished, If you disagree on the amount issued, make sure to write "accepted under protest on the check"
If you had any children or passengers in the car, the passenger has the right to sue separately from your case, and you have a the right to sue on behalf of each child in the car, separately.

Yes. you can certainly sue. What are you waiting for? The longer you wait the more difficult it will be because the judge might say you are fishy if you didn't do anything as soon as you could. Get all your facts together and most importantly you must have a copy of the police report. Without the report, you don't stand a chance. Go for it.

Did you have an insurance policy of your own? In NJ you can sue for major injuries but you can't sue for pain and suffering unless you have unlimited tort on your insurance policy. If you don't have insurance or are on someone's insurance you maybe out of luck because you aren't legal to drive with out it. The car will be covered if was insured by your boyfriend.

yes you can sue him for hospital bills and any time lost off work but you cannot make any bigbucks unless you really broke bones and got screwed up neck and back. In Arizona anyways.
