No, and if they give him any visitation it would have to be supervised. Since he was involved in drugs, he has big points against him right there, and also being in jail shows he is not stable to have any type of custody. Usually (this sounds really negative, but....) people who are on meth usually relapse and shouldn't be long before he is back behind bars.

No, he doesn't have any right to get custody of the kids. However, since he is the biological father, he does have a right to try to fight for his kids in court. Thus, if I were your friend and I knew that the father would try to get custody (which I doubt since he doesn't really care for them), I would suggest getting a lawyer. If what you say is true and can be proved, then the guy will get more jail time for child abuse and you may be able to get a restraining order away from the children. Also, he probably won't get custody unless the judge is mentally deficient, and he will probably have to pay child support.

Might want to check with an attorney, have all the information on hand. Sounds to me like a control issue. If he is as bad as he sounds courts will not give him custody, how will he take care of them in jail ? Drug tests will keep him at bay if he has the money to even strart anything. I told my ex (after I figured it out) If he feels froggie Jump. Child protective services may want to talk to him too.

If he is in jail, he could never get custody of them unless she was an even worse parent and in that case the judge would probably give them to the state or their grandparents. She should start looking into getting some sort of restraining order, if possible.

Get an attorney! In some stes, including Calif. where I live the court has a new trend to favor the father 90% of the time, regardless of circumstances. My kids were briefly taken because my ex was beating me. He got custody because I didnt leave SOON enough! Again, get an attorney...PRONTO!

I don't think he has a chance to get them. If he hasn't seen them in this long, he probably has no rights. Also, a jail record and a history of drugs should keep him away permanently.
Make sure the court has all of this information. Write it all down and try to remember the dates. I hope she has a divorce and has gone after child support.

He has the right to fight for custody. Will he get it? Who knows. Laws vary from state to state, county to county. You're friend should get a lawyer and find out what she needs to do to fight to keep this man away from the children.

He has the right to do anything he wants. But...just because he has the right, doesn't mean its going to go his way. Sounds like the jerk should be in jail for a few more years.
