Legally! Yes if someone/ anyone file a complain(a phone call). And not with the Police but some Horrific No-Brain Bug call ACS. So more damages than justice. The mother can make a complain but she should definitely know if her child were a "666" or a "777" and how long and far the child would test his/her ground.
I do have a concern about if you spanked this child while enraged/negative emotion or acted with discipline? Otherwise, why are you worrying about this now - afterward?
If you did for discipline. You shouldn't have other doubts. My daughter has ADHD and there were times that I needed to give her a Pow Pow so that she would calm down to avoid injury. ACS came to investigate and instead of explaining, I left her w/ my daughter in the car for 45mins.....She became very nice and trusting afterward......

I'm with wonderwoman on this. I would have a fit if anyone touched my kids. I fired a babysitter for spanking my then 2 y/o daughter. Her butt was still red when I picked her up at the end of the day, and the spanking happened just after lunch. I asked my daughter if she knew why she was spanked. She had no idea. Obviously NOT effective as behavior modification.
With both my children, I never spanked them, hit them, or used any physical punishment. I always felt that if I expected them to not hit others, I had to not hit them. Anyway, they were smaller than me, too. Not a fair fight.
The other ways of behavior modification are reasoning with them, time-outs, rewards for good behaviors (I literally gave the kids little glue-on stars for good behaviors, just more time together, little coupons that were good for a picnic, a trip to the park, etc.). There are lots of ways to get them to do what you want or need them to do.
Being a step-parent automatically casts you in the role of the bad guy. Don't give them any reason to make that stereo-type true.

Both of my kids are now 20 & 31, and they are both model citizens. I haven't had any problems with either in their teen years. No experimentation with drugs, sex, alcohol, etc. They are respectful of others and they are two very good people. So it IS possible to raise good kids without laying a hand on them.

Why spank ?
Honestly I dont think you can get in legal problems as long as its just that, a hand spank to the butt and nothing more. There are other ways, better ways to dicipline children.

I'm a step parent too, but even if I had my husband's permission to spank my stepson I wouldn't do it, I dont spank MY children why would I spank someone else's?
I would absolutely not permit for anyone especially a stepparent to my children to spank them. I understand we are all different but please reconsider and dont do it even if you have your husbands permission or if its legal. Try other measures, it will make your relationship with that child better. If you trully love your husband your best bet would be to have a great relationship with your stepchildren, it will make your relationship with your husband stronger.

Yes, the mother can press charges.....
A spanking is considered corporal punishment to a child......
I would be careful....this could get you in serious trouble with the court system!

You as a step parent have to be able to disipline a child, if you are concerned the father could be called in to do it. OF course people in divorce often use the children as weapons, with little real concern over the child, so who knows what they can try in court

honey, the way things are these days u can get into trouble for spankin your own kids!! any nosy person can turn you in if they don't like the way you looked at em. as far as his ex goes, woman are scandalous and vindictive by nature. she could turn you in just to be a *****, be careful when it comes to someone elses kids.
