You can sue for custody but it is very expensive and if you lose you might not see your grandchildren again. If you are worried about their health and/or safety call Child Protective Services and let them investigate. If they find a bad problem they can remove the child from the home until the problem is fixed. Often the children are then placed with a trusted relative.

I am not a grandparent nor does anyone else have custody of my kids, but my mother in law sued for custody of my niece. My mother in law had an easy time proving her son unfit (but that is because my brother in law left the state and did not return AND was a big drug addict.) The advice I can give you is to have lots of hard evidence! Don't try until you are fully prepared and expect controversy within the family. The family WILL get over it but please do what is better for the children! It IS worth it! We need to stick up for kids who can not stick up for themselves!

I personally have not, but my former boss did exactly that. She took her son's girlfriend to court for custody of the grand child because both the son and girlfriend were unfit. She said it caused some animosity between her and them, but that she has absolutely NO regrets about doing it at all. Now the kid can live in a drug-free environment with electricity and water.

My husband grandma raised her grandson from the time he was 2 until date (he is damn near 21) His dad was bad off with drugs and when he quit was just plain uninvolved his mother was a drug addict and was never involved and mentally abusive towards him.. She told me she had more FUN raising her grandson then her two boys could be that they were stable and could both be home with him. Any more it is damn hard to find some one an unfit parent.. they have to be pretty bad off but if they are the courts like to give the parents time to get their crap together and would most likely grant temp custody.

That must be heartbreaking for the grandparents. I am a grandmother and thankfully my daughter is a wonderful caring and very loving mother to my grandson. I would dread the day that she doesn't love him so much that she would not care for him or neglected him in any form or fashion. Good Luck to anyone who finds themselves in this situation.

No, I've not had to. But, earlier this year my Parenting magazine had an article like that. She had to go through a lot to get her kids. And, the grandparents have visitation rights. I think its crap.
If this is your situation - get a good attorney quick.

IMO people shouldnt have kids if they have to have someone else raise their own children. Its a shame, there are a bunch of people that cant have kids, but yet the people that can cannot even take care of them

I'd agree it would have to be heartbreaking to think that the child you raised would ever treat their own children poor enough that you would have to take him/her from them.

I am raising my grandchild. she gave me custody. I did not have to go thru the changes.
