I was out walking late last night (around 10pm) pushing my 1yr old in a stroller through our neighborhood when my neighbor's dog got out of their yard and started barking at me viciously, I started jogging away from their yard and the dog followed me and nipped me in the thigh, I saw it was a lab. I know they normally keep him chained up in the back yard but he got out that time and I feel like sueing them even though the bite did not break the skin. They offered to take me to the doctor the next morning but I said I wanted to go to the emergency room that night and they couldn't because they were babysitting somebody else's kids. They offered to pay for everything and they took a picture of my leg even but I would rather sue them than take their money. I feel they are mad for having to pay it so why should I accept it.....just sue them. They showed me their dog's vaccine record and he is up to date on rabies and other shots. She apologized to me several times but I want to sue.

We live outside city limits;there are no leash laws here but I did file a police report. They said their dog had never bitten anyone. I feel I am a single mother and I deserve to get something substantial out of this, bite marks or no bite marks.

You're just another idiot looking to get paid.
You aren't going to win anything in court. The bite didn't even break skin, and it bit you because it identified you as a threat and you RAN, solidifying this impression to the dog.
I can tell you why your neighbors were pissed off about it. They were upset because you were being childish and ignorant by making a big deal out of such an insignificant situation.
ble witnesses so it's your word against theirs. The thing is, they probably aren't as much of assholes as you are, so they probably won't.
Why don't you just sue the city for every time you've ever fallen down or hurt yourself otherwise whilst inside it's limits? That would be a good idea.
Edit:
If I were your neighbors, I'd just deny. You don't have any marks or viable witnesses, so it's your word against theirs. The thing is, they probably aren't as much of assholes as you are, so I doubt they would do it. Assholes like yourself are a rare breed these days.
A couple more things:
A. What were you doing out that late in a dark neighborhood with a baby and
B. Why were you jogging whilst pushing a stroller with a one year old child inside?

Why should you get a substantial amount for this? Are you seriously injured? Is your daughter seriously injured?
You yourself said that the bite did not break the skin. Why do you feel that you should get something for nothing?
Your neighbour has done everything right and you still want to sue her. People like you are the reason the world is filled with hate.
By the way, exactly what were you doing walking with your 1 year old daughter at 10pm? Don't you know that's not safe?
You sound like a really stupid person that just wants to make a quick buck. People like you should be sterilised at birth to prevent a further spread of stupidity.

I think you're being a little self absorbed and ridiculous.
Any lawyer, judge, or jury would say the same.
The neighbors may not be the most responsible dog owners, but they certainly reacted in an admirable manner to your plight. They did everything that they could reasonably have done.
You could report them to the humane society, if you wish, for having their dog chained up all day.
But other than that, I think you're being a real bottom-feeding opportunist. You say you're a single mom and you deserve something from this. What does that have to do with what happened?
Let's remember that no harm actually came to you here. This was a non-incident. A lawyer will never take your case, period.

Suing them would be ridiculous. The bite didn't break the skin, so no harm is done, other than a bit of fear. Your neighbours reacted right, they helped you, apologized and offered to pay for everything. Why the hell do you think they should do more??? You being a single mother has got nothing to do with what you "deserve" to get out of this. You're being greedy and trying to make a quick buck without having to actually earn it and that is pathetic. Sh*t happens, everyone experiences unpleasant incidents sometimes in their lives, but going around suing over every stupid little incident that comes along makes no sense. Instead of being obsessed with "getting something substantial out of this" you should be happy that your neighbours are at least decent and reacted right. Don't be pathetic and don't make this incident a bigger issue than it really is. And besides, I can't imagine that you'd get anything out of suing them, other than a fat bill from your lawyer.

It has nothing to do with being a single mother.
I think this was a bad experience for you but you should not sue since they tried to help you out as much as possible.
You sound like an angry money hungry bich.
It was bad and all but next time carry some pepper spray or walk in the daytime or what ever.

Um, the reason that you've given for suing your neighbor (being a single mom) is not their fault. If they have offered to take care of your medical bills, be happy with that. And really that is all that you are entitled to. Getting a little nip doesn't make for punitive damages. Get over it and don't go out so late.
People want to sue for everything these days. Stop the craziness! It's the reason our insurance is sky-high!!

How has this situation affected you. I mean the bite sounds very minamal. If you sue you could risk spending a long time living next door to feuding neighbors. Plus the lawsuit can take up to 2 yrs. I would just accept the apology and move on.

I feel your pain. People who own dogs have homeowner's insurance that pays for it's actions. Dog bites are not a trivial thing. But court is no fun. And expensive. Take their money. Document everything and keep a notebook of your case. Especially promises of payment time, date, etc. If it comes to court, go ahead. But you will come out ahead to settle it with their out of pocket expenses. They can file a claim with their insurance company for reimbursement.

You said that you didn't want their money so what I suspect you want is to get even. You could have the police go over and talk to them but that is going to just create more problems in the long run. Go ahead and sue, but do it on Judge Judy. I want to see what she thinks about this, After all you said you didn't get hurt.
