It depends on state to state laws, but often it depends on how far along the woman is. For example, its pretty hard to kill a woman who is eight months pregnant without knowing you are killing a baby too. If the woman is only 10 weeks along, the killer may have had no intention of killing the baby. Not that this makes either act acceptable, but much like abortion, people, juries, and laws qualify acceptable stages of development in the fetus before they judge the death.

I firmly belive that abortion is murder because if the death of a fetus against the mothers will is murder...........well doesn't the fetus have a will also and therefore the fetus was killed against it's own will making it murder. It did not ask to be conceived so therefore has a reason for being here.

They can charge for murder of a fetus. The twist is they claim it is murder because it wasn't the woman's choice. Fact is that abortion is just as much a murder as the killing of a fetus.

First of all, I agree that abortion is murder. Second, in the eyes of the law, I think a baby above 15wks is considered viable and therefore after that it would be double murder.

from what i've seen it's usually a case to case basis, depending on state and local laws, the circumstances of the case, and how far along the pregnancy was. they're more likely to charge a double murder if the woman was in the last part of her pregnancy.

In most states it depends on how far along the women is. But in my opinion there are two lives and the person should be on trial for two murders.

It depends on the state in which you reside. Some states consider it double-murder, some states don't see a fetus as a living being.....yet.

I guess it's only murder if someone ELSE kills the baby, If the mother wants to murder her child I guess its O.K. Hey, maybe we should try to get that "Baby Shaking" thing legalized, too. Hell, if the mother doesn't want the baby then..........
By the way, in case there's any confusion, that was SARCASM, babies have the right to live, born or not.
