If a house is haunted, do you have to disclose that to a buyer?

Yes and no. Depends on the 'nature' of the haunting. While a simple haunted house need not be disclosed, it MUST be disclosed to unfamiliar buyers if the supposed haunting has become so well known that the property value could be adversely affected.

To put it bluntly, a haunting is not disclosed because of its nature, but of its effect on the value of the property.

In some State's the seller must disclose anything that is considered to be a material defect. Some State's require disclosing that a murder took place in the home, that it is haunted, or even that someone died in the house. Check your State's laws about a "stigmatized" property.

Actually in the case of a death within the last 3 years time you are required to disclose it to the buyer,In California anyway, unless it was due to HIV/AIDS. Hope that answers your question.
