You can always refuse the test, and you will probably be arrested. But that doesn't mean you'll be CONVICTED.
Were you up 20 deaths from DUI's? Or were the DUI's more widely reported now there was testing?
I think random alcohol checks are not so bad. If you're not doing anything wrong, what's the big deal? If it saves a loved one from being killed by a drunk driver, I think its a GREAT idea.

They were a failure from the beginning. The intent & purpose was to apply fines to increase revenue. They can be called random checks at random checkpoints or any name a politician wishes to call it - it is still illegal search n seizure.
The 'Probable' comes from you refusing period, at wich point you can be detained up to 72 hrs. Either case, you loose time & money, yet keep a charge of your record, no matter how dishonest (oops - honest) that charge is.

Its a revenue enhancer for the State, County Villiage and Town. They don't care about you or me. Its just an easy target. They should educate people to prevent them from drinking and driving in the first place, but then they can't fine someone and take their car.

You can refuse the test in the US but if you do, the result is that your license is suspended. BUT.... you don't get a DUI on your record.
However, the police have to have probable cause to ask you to take the test - there are no random searches allowed in the US, and a breath test is considered a search.

I believe that here it's illegal to do "random" tests.. I think they have to have a legitimate reason to ask you to take one.. Speeding, swerving, smell of alcohol, lying to the officer, etc.. If they have nothing, legally they shouldn't have you take it.. Though, they are the police and many are going to do it regardless.. I'd think..
If you refuse and they have a reason.. You will get cuffed and taken in.. If they do not have a reason... Supposedly, they have no power and they have to let you go.. I doubt that happens often....
