I got a bill from a company in the mail and they want me to pay them for a product I never received (they said i received it) and never paid for? I dont know what they are talking about. Can they bring me to court? Im scared because its expensive (over 1,000) and It has my name on it!

You may be a victim of identity theft. Contact your credit or debit card company/bank immediately and tell them what happened. They will take you to court if you just refuse to pay it and don't tell them why.

It sounds like a scam to me since you never received the product and have no idea about it.

Send them a CERTIFIED letter DEMANDING they supply documentation that you ordered the product. Include a statement that ANY further contact prior to such documentation will be considered harassment and you will sue THEM. Even if they did sent you the item, if you did not order it, it would legally be a GIFT. That would allow you to keep the item without paying. If they do produce an order, you have a starting point for arguing YOU were not the person that place the order. This could be a scam on their part in the first place. If it is, they are likely to disappear as soon as the demand letter is sent.

There are at least three possibilities:

1) someone defrauded the company using your name, or

2) the company is trying to defraud you, or

3) the company has made some kind of unfortunate mistake.

At this point you need more information. Ask the company for copies of any paperwork that indicates that you ordered and received the item in question. If it looks like someone is defrauding the company, let them know, and also file a report with the local police -- just to get your side on record.

If the company refuses to provide that information, contact your state's Consumer Fraud department and file a complaint against the company. Such a department is often part of the state's Department of Justice.

Again, you need more information at this point, and the company should be happy to provide you with photocopies of the relevant paperwork. Also, just to be on the same side, request copies of your credit history from credit reporting companies to make sure that someone isn't stealing your identity.

By the way, same thing happened to me with a cell phone bill. I called the cell company, and it was no problem to get it cleared up.

start by calling customer service and asking for a supervisor - explain the issue- if they are no help- write a letter explaining what is going on and that it is fraudulent to bill you for this item if they have no proof that you requested it or received it-- to they have postal records showing when it was delivered to your address??? or a recorded phone conversation with you ordering it?? or a signature???

They will take you to court but if you can prove it is not yours you will get off.
It is a big deal though as the lawyer will cost you until it is over

It sounds like someone has stolen your identity. You need to run a credit report on yourself.

You need to dispute the bill with the company. Make them provide proof that you ordered a product and received it. In the meantime, you need to put a fraud alert on your credit.

Let them sue you. The burden of proof is on them to prove that you ordered the product and received delivery. If you don't owe it then the judge will dismiss it.
