You could try, but you would have to go to court, and your ex would have to agree, or the judge would have to believe it was in the children's best interest for the change. If your ex objects, you probably will not be able to convince a judge to do it.

ok, #1 - they are NOT your husband's legal dependents unless the ex-husband signed over his rights & your current husband adopted them. Which obviously hasn't happened since you share joint custody. If your current husband has been claiming them on his taxes, and hasn't legally adopted the children - he has been commiting tax fraud. They are your children or your ex's to claim. The fact they live with you & your current husband does NOT make then your husband's legal dependents.
No, you have no right what so ever to add your current husband's name to the children's.

I'm pretty sure you can give them any name you want but it won't be legal. I knew a lady who gave her kids all different names depending on how they felt about their dads. I don't know if I agree with that one but I just thought I'd tell you.

Only if he adopts them. Otherwise he has no legal rights to them. He may be listing them as dependents for tax purposes, but he can change that in a heartbeat should you and he divorce.

depends on where you live. In most states you will not be able to legally change the children's name without their father's permission.

I don't think you can unless ex agrees to legal adoption by current husband. Once they are 18, they can petition court for any name they want.

you could if you wanted to but if i were you i would make sure the kids are ok with it because that is a big step and you dont want them to feel like there dad is being replaced. Well good luck hope that works out for you sweetie.
