Someone went in to a cell company and forged my name and bought 2 phones and the salesman signed off on the forgery?

You can sue the person who stole your identity. Unless you can prove that the store knowingly sold the phone to a person they knew had a false identity -recovering against the store will be difficult. If they entered into the phone sale in good faith - they are victims also - they are going to have to eat the cost of the phones and any charges incurred.

You will need to file a police report. With proper documentation, you should not be liable for the cost of the phones and any charges incurred. You may want to pull your credit report and make sure there is nothing on there that should not be.

You can sue for restitution against the guy who stole your ID.

The only way you could recover against the phone vendor is if you could prove that he didn't do something he was supposed to in confirming your ID.

I.D. theft. How was the salesman to know?You can try civil court but I don't think you will get far unless the forger gets caught.

If this has harmed you financially in any way, you can sue for the amount you are out. Otherwise, file a police report for identity theft and let the DA press charges.
