My aunt is about to file for divorce from my uncle for the 3rd time in about 3 or 4 years. They have been married since 1992 and have a 12 yr old daughter. She has filed for divorce twice before and both times he did the baby i swear i will change bull crap and never does. So now shes divorcing him again. My question is, is there a maximum number of times a person can file before the courts say you cant file no more or they make you get divorced. I heard this some where and was wondering if it was true. Also if it makes a difference...they live in kansas.

Depends if you annoy the magistrate, but I think this is unlikely because he will not see the filing until late in the game. Chances are the only lose is the attorney and filing fees. Meaning, as long as she is willing to pay the attorney to file it, he will file it as many times as she would like... :)

Not that I know of but someday she might have to answer to a Judge why she filed so many times and the cancelled them which will make the Judge really wonder about her motives

I have never heard that there is a limit for filing for divorce. She probably can file as many as you want, considering you can get married just as many.

Nope my mom has had 2 anullments and 3 divorces ... your aunt has nothing to worry about

No. The court cant make you stay married or get divorced. Even if they do follow through with the divorce, they can get remarried and get divorced all over again. And there will always be family law attorneys out there to help out.

nope - she can file as many times as she wants...there isn't a maximum and no court is going to force it.
