Yes; you can buy a mining claim from the holder. You own the claim but must follow the laws and rules of the federal/state land that it exists on (ecology laws can delay actual mining by years even though that is illegal - mining laws require that mining be allowed no more then 90 days after claim is filed with or without mitigations). One can also file a new claim on public land if certain criteria is met (found a quartz placer, or whatever).

I know many people that pan for gold in the rivers in Colorado, and that is free. However, with mining on land, I believe who ever owns that land, owns the mineral rights. There are land claims that only go down a couple of feet, and then another person owns the land under that, and so forth. It can get very complicated.

Yes, you can still file a claim on federal land, and you can pan for gold also in rivers and creeks.

There are some places in Western NC where you can, ruby and sapphire mining too; tons of fun and it can be addicting!
