Here's an important distinction: if you are awarded Workman's Compensation payments, no terms of negligence apply. Workman's Comp is designed to get you healed up and better again, and to keep the employer from being sued.
So, in a WC case, don't bother trying to throw negligence in there as a factor to get more money. You get paid from a schedule of injuries.
HOWEVER, if the employer was negligent, and KNEW that the ladder was unsafe then you may have a case.
Here's one thing that HIS attorney will bring up: you had already fallen from the ladder a couple of weeks before, and yet you climbed the ladder again. You need to think about how you'll address that line of questioning.

There are lawyers who will take the case on a contingency basis and if you win your case, they will take a certain percentage of the amount that you are awarded. No upfront out of pocket money expenses.

I would contact a laywer in your area and go to the court to schedule a hearing again your employer. All you should need is they're name & address. Good luck! =)

im taking business law and you can sue him for negligence.im only in 9th grade but we just did like a whole chapter on this stuff. and i do live in washington

Talk to an attorney. The initial consultation is generally free. If they decide you have a case ask them to handle it for a percentage of the award. If they will accept that go ahead, if they won't accept that they're probably not sure you'll win. If they don't believe you have a case it's probably wise to fore go a suit.
