, and wants to come back to live for 3 days before he leaves for good, should i allow this or is his not living in the house for 40 days right to not allow and make him leave????

If he has a lease and the rents are paid, you have no legal basis to refuse him entry to his own home. Even without a lease and unpaid rent, you still must proceed with the normal eviction process through the courts to put him out. Don't even THINK of locking him out or refusing him entry, even if the rent is unpaid. That would put YOU on the wrong side of the law and it's a criminal act in most jurisdictions.

I'm not sure what you mean "lived on the security deposit"? I assume you mean they haven't paid rent.

You can't lock-out a tenant unless you have gone through the eviction process -- regardless of how long the tenant has abandoned the unit.

The security deposit is not rent. If they have not paid rent in 40 days and were not there the house/apartment has been abandoned. You do not have to let them in.

Do not allow him back in, if you do you will have to go to court to get him out. Don't do it.
