and has filed the proper paperwork is it customary for the company they work for to call them not to say " Come back to work" word for word but to subtly imply that there are others who need time off too and they just wanted to check on you to make scheduling arrangements? I have had to extend my leave twice and will go back on Thursday pending an ok from the doctor on Tuesday.

In today's economy where everyone is doing the work of 2 or 3 employees and the employees are not looked at as assets but as expenses, it is very common for the employer to urge/pressure employees to return from sick leave. While not illegal, it certainly does pressure the employee to make the sick leave as short as possible. Legally there is nothing that can be done about it.

There's nothing wrong with them wanting you to come back to work. As long as they don't FORCE you, they're well within their rights. It's also pretty reasonable for them to discuss scheduling; otherwise how will they know how many other people need to work to cover you?

If you are on FMLA and have a doctors excuse then they can not harass you. If you are not on FMLA then they have every right to call you back even if you have the doctors excuse. You are physically unable to perform your job duties, so they can fire you and you probably wont get the unemployment.

They are not breaking any laws (well laws vary from place to place, but in most instances labor laws are close).

They are permitted to get an estimate of when you'll be back to work, and even if they have the doctor's note saying on such and such a date, they are permitted to call and see if there's a chance you might come back sooner.

Furthermore, they are being reasonable and responsible as an employer to get facts about your return before making other employee's schedule. If you're off, and there are others who are going on sick leave, then many other remaining employees might be having to rearrange their normal scheduling in order to accommodate.

I see nothing inordinate about the call, nothing intrusive, and nothing close to illegal, but this is based only on the details you've given at this point. Depending on exactly what they said or asked, they may have crossed the line, but so far it doesn't seem so.

They have the right to inquire about your status for managerial purposes, and this is a managerial purpose.

As long as they are not ordering you back to work, it is ok that they may want to check with you to see what your status is. Like it or not, life does go on and they do have other employees that may need time off and if you are not able to come back to work, your employer may need to make difficult decisions.
