where can i get the rights to their logo & name??

During a bankruptcy process, the assets of the company are sold. This would include the name and logo. Review the bankruptcy filing for the company and see if you can determine who bought these.

Although the company may not exist as a legal entity, a company cannot be completely dissolved until all assets have been transfered to respective owners/shareholders. A name and/or trademark is considered intellectual property, which would have been recorded on the books as an intangible asset. Either the company has not been dissolved, in which case the copyright to the name would still rest with the company, the rights may have been transfered to an owner if the company was privately held, or the rights may have been sold, with the proceeds going to the shareholders. In any case, copyright infringement isn't illegal, it's a civil matter. If there's nobody to sue you, there's no reason not to use the name. If you are looking to prevent others from using the name, I would get an attorney, because companies literally spend billions of dollars continually defending copyrights and trademarks and lose if they are not properly secured.

you will need to know who owns them. contact them an see if they are willing to sell the name and or trademark yo you.

Can't see why you would want to be associated with a loser, but anyway...

If the company that held the rights has had its corporate powers suspended by the state, there may be no one to sue you if you use the logo and name.

But, in the bankruptcy and/or dissolution of the company, it is possible that someone received an assignment of those rights. So, you would need to review the company's legal history to determine who the owner is today.

You can search the US Patent office records and the registration office of the states where the corporation did business for this information as well.

If a valid entity or individual holds these rights today, you can then negotiate to use them.

But really, this is a lot of work only to end up with the name and logo of a company known for going out of business.

contact the U.S. copyright agency and ask them
