most states are pretty uniform in their point system. they all allow 4 points for a learners/provisional drivers license. A careless driving citation is a pretty serious ticket. You can either plead not guilty and go to court. but its a pretty rare occasion that the court would reverse the ticket. or pay your fine early and take the reduced points by doing so. Any way you shake it out, your going to wind up with points against your licenses. if your only looking a two points, then take the two points and save your money. start driving with a little more care and responsibility.

Dear Paul I hope you listen to this advise. I know you think that your reflexes are at their peak at 18 and that you can avoid an accident just in the nick of time. And, if your reread your question from above, you will see that you are using words like unfair, officer not on scene, other person tailgating. You will have to learn to stop shifting the blame for what you are doing and take responsibility for your own actions. My son, when he was your age, had the same attitude that it was always someone else's fault. The driver in front was going too slow, so he had to pass; someone was tailgating so he had to get out of the way, he was running late so he had to weave in and out of traffice and speed. He totaled two cars in the space of 3 years. Both times he couldn't avoid an accident because he was going to fast to stop, both times another car had swerved into his lane. The first one was a head on with the other driver, the second - although he avoided hitting the other driver he ended up rolling his car three times before it stopped. It doesn't matter what the other driver is doing, it is your job to drive safely, obey speed limits and finish growing up into the great young man I know you can be. Yes, get an attorney. The attorney can hopefully reduce your fines and supervision time and since this is your third ticket, perhaps save your license. Please learn to drive safe, an accident at 95 mpg doesn't give you much of a chance of walking away uninjured. Mike's Mom

You need to contest the ticket, requesting a hearing. Most likely, assuming you have no other tickets, you will be allowed to plead guilty to a non-point violation that will, however, cost you more than if you had paid the original violation. It may be as much as $400. This partly depends on the police officer's and judge's willingness to allow you to do this, but most likely they will. I have a NJ license and have done this twice, a few years apart. One time the judge wouldn't allow the non-moving offense to be substituted but did substitute a lower-point violation, so it was still worth going to court.

In New Jersey, your points stay until the law says they are removed. Usually 2 years, sometimes 3 or more.
Nothing you can do about that.
I would suggest you pay the fine immediately. New Jersey is very tough on careless drivers...and so are Insurance companies.
Look for your (or your parents) insurance rates to skyrocket......
