We’ve been though court and i now have soul custody. He has visitation every wed, and every other weekend. I was told that before i could get support he had to have a job and making over $8000 a yr. He's 17 (18 in April) has dropped out of school, and only has two credits. So because he is a failure he don’t have to support his child? He's stated that he will not give me child support, and i know as long as he lives with his mom he will never have to get a job. He’s also never had one that wasn’t under the table. I’m willing to go back to court. Is there any way i can get around this?
I’m trying to do the right things, I’ve tried reasoning with him. Since he don’t want to give me money with out a court order (and the only way he is making it is dealing drugs.. that’s a hole other story.)I’ve told him i would be happy with a pack of diapers, and outfit, even a Sippy cup! The only thing he has got his son in the 20 months he’s been living was 2 outfits.
I live in WINDSOR ONTARIO

I doubt that you can force anyone to get a job, and I KNOW you can't force someone to grow up. If he doesn't like whatever legal action you take, he'll just move. I would go to court and get his visitation rights reduced.

Take him to court and the court will make him get at least a min wage job and base support on that. Don't wait do it now!

are you working full time? i know it's tough for anyone, man or woman to raise a kid but if you're making it on your own you might want to let this bum go. he is only screwing up his own future. what you could do is have the custody changed so that his is forbidden from ever seeing your kid until he grows up, gets a regular honest job and starts taking care of himself and being responsible.

"So because he is a failure he don’t have to support his child?"

Pretty much, yes.

You can't get blood from a stone, and if he doesn't have any money, he can't pay it to you.

Unfortunately, these are the things you should think about BEFORE making a baby with an unemployed teenage loser.
