You don't need a lawyer. College applications or acceptances are not hinging on your indicating your gender. Just show interest in your position, even passion, and respect for them, by explaining why you are not following their customary procedures.

By law, you don't have to identify what gender you are, or religion you are, or nationality/race you are. Likewise, colleges can't legally base their decision to accept you or refuse you based on any of those things.
The reason they do ask the question is for their breakdowns - what percent of the campus is female, what percent of the females are studying a certain field, and so on. It also helps them find a fit for housing, group activities, and so on.
You don't have to answer it, but there is no harm in doing so. But the decision is totally yours.

It shouldn't matter, as in job applications, it shouldn't be mandatory that you notate gender, or race, they are just for national statistics.
