It depends on whether or not the clip art is "public domain" and "royalty free" or whether the owner of the restaurant has paid the artist for the use of the clip art picture.

If it is public domain or royalty free, anybody can use it. If it is not, the artist should be paid for the privilege of the restaurant using the picture.

Regarding the items that come with Microsoft Suite--- Since you've paid for the license for the Suite, you've also already paid to use the included clip art for whichever purposes you see fit (be it commercial or not.) The license agreement specifies this (something like 14 pages into it.) It you're looking for more photographic representations, please allow me to suggest www.sxc.hu This site maintains a large database of photos (most of VERY good quality) submitted by amature and pro photographers for general release. If a photographer doesn't want an image to be used, it will be specified- but well over 95% are free to use. (Courtesy there says that you inform the photographer how the image is being used.) Good luck!
