This is the situation.My husband have a house in Costa Rica.The house was awarded to his mom years ago and after she passed away went to him.However,he never had the title.We went to court and after 6 months the courts declare it his property(we have that in paper).There are some taxes due,not much about $100 but until we know the exact amount and pay it we don't have the title to the house.All is left for the courts to send us the amount.Can we pre-sell the house?

You're going to need at least a real estate agent, if not a real estate attorney, in Costa Rica to handle the sale. That professional, familiar with their laws, can answer the question. So long as the house were advertised with the understanding of WHEN it would be available, etc. it probably can be done legally. It seems that Latin American countries are stricter in some ways about their real estate transactions and I don't see any way around your hiring an attorney to clear the whole thing up (from paying the taxes and obtaining title to selling the home).

Nope, you must have the title to any home or real property in order to sell it. You might be lucky enough to find a buyer on a tentative arrangement pending you getting the title but you could not consumate the deal and make it final until you are in possession of the title.

You can write a contract agreeing to sell it in the future like a rent to own. Put in something about what happens if you never own it so can't sell it.

You need to do your homework regarding selling in Costa Rica. All real estate laws vary.

Not exactly, since you don't own it yet, but you could make an agreement with a potential buyer to sell it to them at such time as you do.

Thats a good question but i dont think so.....itll be fraud..its like me selling your house that you live in now.....FRAUD
