sorry for before but this is how it is.

i brought my friend over in america a gift, it was over a year ago and now i feel he doesnt deserve that gift. can i sell a gift that in his house that i brought for him with my money in my name on ebay?

You can sell anything that is allowed on eBay, and you can sell the gift

The problem, however, is getting the gift. Since you said the gift is in his house, what if he refuses to give the gift back to you?

It doesn't matter that you have the receipt. Put your shoes in the buyer at eBay -- you bid on the item, won the auction, and then the seller cannot send you the item because the person who received the gift did not return it back.

The buyer will not care about receipts and the story behind the gift retraction. He/she will only care that you are able to send the item he/she won in the auction.

If you can get the item, sure sell it on eBay. But before you make the listing, be sure to get the item first and have it on hand ready for shipping. Don't try to get it only after someone has already won in the auction.

If the item is legally yours, and you are in possession of the item, you can sell it. If it is in someone else's house, how would you be able to ship it to the buyer? You can not sell something and let another person be responsible for the shipping, unless you have a signed agreement or contract. If they don't ship the item, you can be charged with fraud.

PS if it is was a gift to the individual, then you can not sell it at all, it is no longer yours, unless you have a signed contract that you could ask for it back at anytime.

Oh...I didn't know this in your previous posting. No Shady, you can't sell the gift unless he gives it back to you. Regardless if you have the receipt or not, you can't force him to give the gift to you or to mail the gift to someone who buys it on eBay. So if you do list it, be prepared to either risk having your eBay account canceled or having to buy the same item at full cost for some random purchaser on eBay. I think you would do better to just cut your losses and forget about it.

So you want to sell something that is not technically yours? Selling stolen property? And how do you plan on getting it to take a picture of it. or ship it. I'd say you have bigger issues than selling something on ebay.

And, no, you can't...unless he gives it back to you.
