If your boyfriend used more force that it was necessary to stop your brother from hitting/hurting you, yes he can go to jail if he files charges against your boyfriend. Diplomacy may be the next best thing to consider, tell your boyfriend to apologize and explain that it is not nice to hit ones sister.

you don't have a strong case. Your brother only slapped you but your boyfriend beat your brother in which he can claim that the result of the beating caused physical injury to him.

Yes, he can say that he was defending you in theory. He'll probably have to prove some things to claim this defense, like he thought you were in danger, and his response wasn't drastically out of proportion to the slap (seems like it might be difficult in this case), and possibly that you couldn't have safely ran away depending on your jurisdiction.

um wow tough...in my opinion, i would rule on the favor of ur boyfriend...ur brother shouldnt be hitting u...its BAD to hit girls. and ur boyfriend hit a guy so its not that bad. still bad, but not as bad. i say press charges against ur brother so it would be fair game. hopefully no one goes to jail. i say u talk to ur brother about this. tell him what he did was wrong. and if ur brother doesnt hit u anymore, then ur boyfriend wouldnt hit him anymore, so everything is peachy.

Your boyfriend can claim defense of others (you), but if he went overboard and beat your brother more than what was needed to protect you, he can be convicted of assault and battery.
