The court order reads...

Parent # 1 shall have parenting time with the child for one-half of the child’s winter break from school, and this winter break parenting time shall not include Christmas Day, so that Christmas Day is spent with Parent #2.

Would it be unreasonable to assume that this time would be divided by week and that it would be ok to makes plans for the whole week of Christmas? Or vice versa...

Please give opinions!!!

what would be smart would be for the two ADULTS to figure out the winter break arrangements that are best for the CHILD not what is best for either parent; but since that is not what you asked, assuming the child is out of school for two weeks, then one parent gets the first week and the other gets the second week.

to start with our opinions do not count on this one you need to either work this out with the custodial parent or have the court clarify this order as not all school breaks are the same even from year to year, because christmas does not fall on the same day every year that means some years they will be off longer before christmas than other years, so i would not assume anything, if the child is to spend half of the time with each parent except that parent 2 gets christmas day might mean it has to be split up different ways because it falls differently every year

Basically it puts the child with Parent#2 at Christmas so it would be best to plan that the child be with that parent during the week that includes Christmas and with #1 during new years.

Parent #2 gets the week that Christmas falls on..... Parent #1 gets the other week.

So whoever parent #2 is, they should be making plans for the whole week of Christmas.

I don't know if this will help or not, but , xmas break is usually divided in half between the parents after taking out the holiday. Holidays are usually exempt from normal visitation, therefore, don't count the holiday/s during the break and divide the remaining time equally. If you're not sure consult an attorney or your parenting time coordinator (if your courts have one).

I agree with you. But, if your situation was like mine. I made plans, paid for the airplane tickets and she made them miss the plane twice.

Women can be very devious and revengfull and use the kids as a tool to get back at the husband. But, she is only hurting the children.

I would assume you could make plans for 1/2 the vacation. But, they need to be with the other on christmas day.

I'm so sorry you have to go through this, I was lucky. WE cared about what was best for our children and did not trying to control the other person. Our children were healthier and happier for it.
