If you have nothing.... no assets (house, car, money, IRA, 401k, computer, music collection, other stuff) and no children, then yes.
Otherwise NO. Someone wanting out of marriage has no bearing on them being agreeable to anything.
A strong marriage involves communication, negotiation, compromise and a general respect for the other person. Since you're so happy about the divorce, that usually means the above isn't in place. So why would you expect it to magically appear during the divorce?!?
Make sense?

oh it would seem so until said spouse starts talking to family and friends who tell all kinds of stories and insist he/she get a good lawyer and then.... it will all change.
Don't count on anything. Do what is right by the law and be fair. Or you never know what could happen.

hmm.. but would you still want the divorce? being able to do back flips is pretty cool, and if you're married to that person, that might kind of make you cool by proxy.

Or they know something that you don't and the element of surprise is on their side. Better take a better look at things.
