My husband passed away almost a year ago - is there a way to revert to my maiden name without going thru the whole change my name in court process? I still have plenty of ID in my old name. Just my SSN and Driver's License are in my new name. My husband was NOT a good man, and no longer want to carry his name. Any ideas?

I'm so sorry you had a bad marriage, but you will have to go to court to have your maiden name restored on your Social Security, Drivers license etc. In most states its like $40.00 to file the paper work and you can just do it yourself without a lawyer.

I would say it is possible, but that not all institutions will recognize it. To begin with, I would first obtain certified copies of your marriage license and husband's death certificate. Then, I would complete a name change declaration like this one: http://www.deadendinternet.com/media/NSFWM%20Forms/Name%20Change%20Affidavit.pdf - and have it notarized.

Using the combination of your declaration, death certificate and marriage license, and if you explain the situation to the clerk at the Driver License office, you can probably get them to change it. That's the hard part - after you have the new Driver License, it will be easy to get your Social Security card changed. Simply send a copy of your new license, along with your declaration, marriage license, and husband's death certificate, and a letter of explanation, to the Social Security office and I'm sure they'll change it. Fill out a change of name for your drivers liscense and ssn card. Change it at the bank and any charge cards you may have by calling and asking how they want to do it. Make sure you have death certificates as proof of his demise.
Start using your maiden name and tell everyone of the change.
When you file income tax, change your name on that also.
At work, have them start making your pay checks out to your maiden name. Soon everything will be changed over.

In most states a attroney can handle this for you. This is a fairly easy process with a attorneys help and a quick process. The hardest part of the process is getting the new driver's license, SSN Card, and informing credit card companies etc.

I dont think you will have much legal drama. If I am not mistaken you can take your husbands death certificate, your marriage license and go down to the SS office and change your last name back to your maiden name.

Yes you can, all you have to do is submit for a name change thru the local courts/local government and bring the death certificate with you. It should be just a simple procedure, yet just needs to be handled legally through the court/local procedures.

Check the laws in your state to find out what they are. Call the county clerk's office and find out how or if it is necessary to file paperwork to use your maiden name. I don't see why widows would have a problem but you never know.
