i know all my USB ports work because i have the SAME joystick ( its just messed up a bit thats why i got a new one) and as soon as i plug it in windows detects it. so i went to try the new joystick and even the software that came with it doesnt detect it. could it be a "defective" joystick?

You need to uninstall the driver for the old joystick, reboot your PC, then plug in the new joystick. Insert the new install disk when Windows prompts for it. Even if it appears to be an identical joystick, the manufacturer may have made an update so it is incompatible with the original driver.
