If you are the owner, then they do not have any rights beyond what you extend to them.

having said that, if your father passes away, and you are burying him in a plot that you own, the right thing to do would be to allow his widow to put the headstone up, if for no other reason than to maintain a friendly atmosphere, with no hard feelings.

If the plot was owned by the deceased, and he/she stipulated what the funeral would consist of, then their wishes should be honored.

Uhm... I am sure other people will give much more knowledgeable answers - but - on general grounds - the widow inherits the posessions of the deceased and that will include the grave - and so she can decide. I guess it won't hurt if the person specifies in his will what he wants with the grave though - if he wishes for his widow or whoemever to make decisions, etc.

Sorry; your property rights expire with you. Your widow/heirs will decide what eventually goes in and on the grave; hopefully with respect to what you have already done.

It's not as if you can sue if it isnt what you want.

Legally, when you purchase a burial plot, you hold title to that small piece of land the same as if you bought a house. Perhaps a condo would be a better analogy. I never thought to ask if it is technically part of your estate. If it is, your heirs would inherit it and presumably have all the rights of owners.

The councils have the last word as to who may take the headstone into the cemetery's. we bought a head stone for my fathers grave and was told we had to get permission from the council to take it into the cemetery. the councils got to have the last word. it`s for healt and safty reasons.

I would imagine the owner has all the say unless he himself is in the grave then others can probably do what they want.
