How come her 19 yr old boyfriend is not in jail for statutory rape?

Well, it depends on where they live if it is statutory rape or not (I've no idea where they are.)
Also, depending on what state they are in can possibly limit who has the right to file such charges (in some states it must be the parent or guardian of the child.)

1. According to the state law 16 can consent so it's totally legal (I think it should be)
