I dont think so if they didnt break a lock, door or window to get in, they just walked in, maybe they were drunk and confused as to who's apartment they were in.....

i can,t say for sure it would be breaking and entering, but
if a complete stanger, someone uninvited walked into your
home i am sure it would be some type of violation of the law.

Just call 911 in the future or shoot them and drag them into your apartment. It is called self-defense - don't kill them - shoot for the knee or private parts
