Even if you won - you would be awarded the depreciated value of the clothes - what you could have sold them for. You would not be awarded to cost to replace them. You would also have to prove your roommate did it.

If it's only a few pieces - probably best to forget about it and move on.

Hold a grudge much? jeez.....get over it....3 months ago...no wonder the roommate moved out. You can sue anyone or anything, but don't be surprised when you lose and get to pay for not only your legal fees but theirs too, and don't forget the court costs. Wouldn't new clothes be a smarter way and certainly more fun than being locked up in a court battle?

Small claims is your best bet. The damages would not be worth the price of an attorney and the police may look at the issue as a civil matter. You can still try and call the local police, but I don't think it will do much good.

Don't even bother. The court/lawyer costs (not to mention the possible counter-suit costs) will FAR exceed whatever small amount you'd end up getting should you actually WIN your case (which is VERY doubtful).

Just chalk this up to experience, and move on. He/she will "get theirs" someday. Everything seems to come back to bite people in the a$s these days...so its just a matter of time.

a police report would be the 1st step to take but 3 months is a little long now. I dought it would go very far.

First of, it was very foolish of you to borrow her money especially after the fact that you two didn't get along well. You will have to go to a civil trial/court to settle the debt. She owes you money, the thing that's going to be a little tough is proving the fact that you lend her the money, because it was verbal and not written anywhere. Good luck!

call Judge Judy, or file in small claims court. The police aren't going to do anything.

so what are your damages? can you prove criminal intent? have fun calling the police, finding an attorney who will take the case and a judge who will rule in your favor.

It's not worth it. Get over it.
