I have always wanted to open my own bar. Now that I am close to being able,these stupid smoking bans are coming into effect. I just want to know what the exceptions are. I heard one person saying Cigar shops will have exceptions.
So what are the exceptions to this smoking ban in Illinios.

This is not the place to find out. If you are going to sink a significant amount of cash into your business, the FIRST thing you should do is get a definitive answer to your question. I've been practicing law for over 25 years and I would not hazard a "guess" on such a criitical issue here. And I know how to find out, generally, what law applies. And I'm here to tell you that if you believe ME, you are asking for trouble. "Findlaw" and Wikepedia are not reliable sources. That's generally what you will get as authority here.

When you apply for your liquor license, you will get all the information you need to decide how to proceed. (This information is probably on line for you to review or you can get the information from the Alcohol Beverage Control and/or the Secretary of State.) As a GENERAL rule, smoking is banned in bars that have a certain percentage of food sales. Not serving food often triggers other restrictions, such as opening times etc. Again, all of this is available to you.

I would suggest that if you think "stupid smoking bans" are going to deter you from opening your bar, you probably should not do it. Bars all over the country are flourishing in spite of it. And yes, there are enough "exceptions" that will allow your patrons to smoke. It seems to me that you are more worried about smoking than anything else. Bars are subject to very strict regulations. That's just the way it is. A smoking ban is just one of them. If government regulation is a problem, trust me. You are going into the wrong business.

As of now there are no exceptions to the smoking ban in Illinois. Any public building and businesses including bars, restaurants, private clubs and casinos are subject to the ban. But as they have yet to figure out who is going to enforce it and pay the cost it could change. But I agree with the poster who said to check all laws before opening your bar. It is one of the most regulated businesses here.
