my fiance has two kids with someone else but she and her kids live with me .and she is still married an the daddy dont pay nothin for the kids .i pay for everthing so can i claim the kids ?

Only if nobody else(the father or mother) claim them

If your fiance doesn't mind and as long as the Daddy doesn't claim them 1st then sure you can claim them.

Kids can't be "claimed" unless you are talking about income tax...and in that case you would have to be married to include them on the tax forms.

well she needs to divorce her husband and then marry you. Then depending on the age of the children, they can take your last name. My sister did but since her oldest daughter is old enought to understand whats going on, its up to her daughter whethere or not she wants to take his last name. She is 10 years old.

only if you legally adopt them upon marriage to their mother,so they can legally take your last name.
