It depends. There's some of each. But even if they get the money up front, lawyers still want to win. If they lose a lot, they'll get a bad reputation, and they won't be able to get much business in the future.

Depends on the case/court/client.
Some charge a certain rate for the type of action, plus court and office expenses. Criminal defense and family law work like this because there is no monetary award from the trial.
Personal injury/tort lawyers may take your case on a "contingency" basis where they only collect a certain percentage of whatever you are awarded. They assume the risk that you may or may not win in court and could come out of it with a percentage of $0. The higher the risk in the case, the more likely they will want a higher percentage of the award.
Lawyers paid up front still care about the case, because their ethical responsibilities are to zealously advocate for their client. They risk being disbarred, suspended from practice for failure to properly represent their client's interests.
Keep in mind that in every case, someone loses...so there is always a disgruntled client mad at their attorney 50% of every case. Even the winning side gets mad because their attorney wants their cut, so they are often disgruntled. But attorneys have to be compensated PLUS pay the overhead of running a practice (that $40,000 paralegal and office don't come free!)

They generally get paid throughout a case. It depends on the case, the lawyer, and what is going on. Sometimes they get paid after their client wins a case. It is all discussed up front as to how they will get paid. Even after a legal issue there is still legal ssies that are addressed and needing paid. depending on where you are, lawyers charge about $250 per hour. This pays their staff, supplies, office space,etc. So they dont get all the money, they use it to stay in business for other clients.

depends on what kind of lawyer you have you would actually have to contact the lawyers office for specifics some charge by the hour, some charge by the case or through out the case and some dont get paid unless you win ie... personal injury lawyers

Lawyers care about winning cases for several reasons. My two biggest reasons are:
1.) I care about my clients.
2.) Future business.
Your fee is not going to make me wealthy for life and I won't be around long if I don't do zealous work.
To answer your first question, as a criminal defense attorney and domestic relations attorney, I require my fees up front in every case. Attorneys are paid for their time and their knowledge, but they ultimately are stuck with the facts of the particular case.
It is important to have a reasonable expectation of what "winning" in your particular situation is, and you don't say what type of legal issues are involved. Check with several attorneys in that area of the law before you retain one.

He cares because you could sue him for legal malpractice. Lawyers can be paid up front, or if your case is a sure winner, they will consider taking it on a contingency fee basis (he gets a portion of the money you receive in settlement or judgment).

In some cases, they ask for a retainer up front (a deposit) then charge by the hour, plus expenses. If you don't have any money, they will ask for the deed to your house, or title to your car!.
In a liability case, they will ask for a % of the award.
In some cases, they will ask for a flat fee, such as in an uncontested divorce or estate settlement. After an initial consoluation, they won't answer the phone unless they are reasonably assured of getting paid.And, believe me, they are often in a position to say " take it or leave it.'

It depends on the case. In a criminal case a lawyer would probably expect evidence of your ability to pay (like property or credit) before taking your case.
If you are suing someone, she might take a portion of any settlement.

In my experience, i've always had incredible attorneys i gave them total fee up front, they gave me exceptional service. Attorneys that give you those kinds of terms are probably rip offs. It all really depends on what judges they sit down and have coffee with. : )!

Do they get paid ful before going to the court with you? If that's the case, why does he case about losing, he's got the money already. Or do lawyers get paid certain portion of the full amount before going to the court and winning or losing the case decides whatever he gets the rest of the money or not?
