Is my divorce considered "contested" if my husband refuses to sign the papers?

...although we have nothing to fight over such as kids, property, money, etc? We were only married a couple of months. If it IS considered contested then I have no choice but to hire a lawyer. But if there is nothing to dispute, then can I be granted a divorce anyway? I never did anything to him. I never cheated or anything. He assaulted me, and now I'm trying to divorce him.

KEITH, He's assulted me twice. Almost broke my arm. Tried to hold a pillow over my face. When I fought back it only got worse. Do you not think if I fight back that he won't end up killing me? HELLO! I also don't want my kids to have to live like this. If it's against the Bible, then I'll sacrifice myself to hell for my kids sake.

Listen if he loves you that much than you shouldn't get a divorce the bible says divorce is not good okay love him and try to work things out unless he cheats if he beats then cook some hot grits (a very big pan buy it if you have 2) pour them on him and beat him with a frying pan

I'm not an attorney but my daughter just consulted one about this very subject and was told that "Yes, it IS considered contested if one party or the other refuses to sign the papers." This is in the State of Tennessee, however, and the laws in your state may be different.

EVERY divorce IS contested. Even if the court does not consider the divorce contested, it is the 'nature of the beast'.

even if he refuses to sign the papers you can do a divorce without an attorney. if you have nothing to divide & there wasn't any children - the judge just signs the papers. all you have to do is prove you served him.
