I just found out through a family member that 35 years ago when my great grandmother passed away she left her home in a will to me and my brother.both of us underaged at the time.my uncle took over and sold the property to my god parents who lived next door.was my uncle able to do this?can i possibly get the property back. it is located in imperial beach california. Would i need a copy of her will? and how can i get it.She died in imperial beac ,san diego county. any help would be appreciated. thank you

You'll need a lawyer.

If what you were told is true then you may well have a case for a suit for a breach of fiduciary duty against your uncle.

If he was the administrator then he was legally allowed to sell the home - but the proceeds had to be looked after for your benefit.

Hire a lawyer. It may cost you some money, but it is the best way to get results. A lawyer will get a copy of the will from the Register of Wills, review the estate file to determine the circumstances of the sale of the property and whether it may have been authorized by the court, and do a title search on the property.

You may have a cause of action against both the uncle and the current owner of the property, as well as any title insurance company that insured the title to the property or any attorney who certified the title pursuant to a conveyance of the property.

if you get the property, be ready to deal with the IRS. they'll want their fair share.
