How can agency administrator employ in order to effectively hire qualified staff without running afoul of discrimination in the work place?

CYA by winnowing resumes of unqualified applicants and applicants who appear qualified, but don't have references that check out by filing them separately from the applicants you are actively pursuing for the job. Do not discard these resumes until after the position is successfully filled.

Mark each and every resume you pursue with your notes about the individuals references, job history and education. Date and initial them too. Run a credit check on every member of the final applicant pool.

If at all possible, conduct the final interviews with a group of people in your organization and ask for their formal feedback on each of the applicants. You will most likely end up with a more diverse workforce that way. And the workers will be qualified and competent too.

This way your entire effort is to obtain qualified workers, and it remains religon, gender and race neutral too.

Hire the most qualified person for the job, PERIOD...whether that person is a man, woman, black, asian, white, catholic, hispanic, jewish....you get the idea.

"Most qualified" means they have the best record of experience, an appropriate education, a vehicle if needed, a certification, and/or whatever else is required to perform the job.

Have written evaluation criteria for applicants, and follow them in choosing who will be hired. Evaluate applicants based on education, background and experience, and references.

If you find that some minority group appears to be being excluded from hiring, try to recruit applicants from that group.

Is the implication that minority candidates are not qualified?

If such is the case, not hiring them is completely legitimate.
