It was left eith condition they broke up he got it back. She says it was a gift and won't return it. He has all reciepts in his name. would he win in civil court

call police for a "civil stand-by" to go pick it up, if she does NOT return it then, it is THEFT.

You said they broke up and he got it back. So how is it she won't return it if he already has it?

Would he win in civil court? Maybe, maybe not. Next time he'll be more careful with his expensive items.

It is a case of he said/she said and since he left it there most likely it will be considered abandoned or gifted and chances of his getting it back are slim. It stinks but that seems to be the way things go when couples split.

Legally I don't know saw some good answers above I would consult police on this they may get it back (or report it stolen)
Or if worst comes to worst you could just tell her(lie) you have stoped payment and the company has her name ext and they are coming to get it!

Just watch a couple of Judy Judy episodes for your answer. Or maybe check her archives. I would say yes, but who knows. Is it worth it? Just chalk it up to one of life's experiences, and don't make the same mistake twice.

If the facts you presented to us are true and the judge believes it, then yes he will win.

Tell him to take the Pantera shirt off and wear a nice suit to court.

If it's in your son's name and the receipts prove it then call the cops and have them cuff her for theft. Then get your property back.

Then kick your son's a** for dating a mooch.
