i got a 3 phone about 4 yrs ago ,12 month contract,phone broke after a few months so i sent it off to be repaired ,i had insurance for it ,i was messed about too much so i canceled the contact in writing ,when then12 months was up i got abill for over 200 pound ,i thought i had sorted it out ,then 3yrs later i got a letter from hfo asking for 260pound ,then the phone calls started,,and they were not nice,they asked me if i had ever been to court,i said no,she said it,s not nice going to court at your age,they phoned up to 6 times aday &night,now i have got aletter from the solicitors for 355.61pounds,or go to court and have court fees as well to pay,if i go to a solicitor i will have to pay them ,so i can not win,i will still have to pay out ,but i dont want to pay hfo when i dont owe 03 for the phone ,thankyou ,hope some one can help me .

When you sign up for a cell phone contract, it's a contract, and you're bound by it. You can't just 'opt out' of it when you feel like it.


But..... How old were you when you signed the contract? If you were underage then it might not be valid.

Your other option, if you were an adult, is to defend their suit on the grounds that THEY broke the contract by the way they "messed you about".

For 350 pounds, the suit will be in small claims court, so you don't need a solicitor.

Basically your choices are
1) Pay them. Either in full, or negotiate a settlement.
2) If you were underage tell them that and say the contract was invalid.
3) If you were adult, tell them you think the cell company breached the contract, so you're not paying. Then if they sue you, you take everything you still have with you to court and try to persuade the court that they breached, not you.

If you lose, well, you're out the amount you'd have owed anyway.
